Sunshine Act Updates — CMS' Open Payments system now functional

The CMS site had been down since Aug. 7. Registration on CMS’s website is voluntary; however, physicians must complete Phase 2 of the CMS registration process if they wish to review their personal financial information before it is made publicly available on Sept. 30, 2014.

The Open Payments portal application is active at this time. Please attempt to connect and review your records.

On September 30, 2014, financial information about physicians that is reported by manufacturers pursuant to the “Physician Sunshine Act” of the Affordable Care Act will be aggregated and posted online. In addition to ownership interests held by physicians and their immediate family members, various types of remuneration received by physicians and teaching hospitals from manufacturers will be disclosed.

Physicians will have a limited opportunity, 45 days, to review and dispute the data before it is published on the public website. All data must be reviewed by August 27.

In order to review the data and dispute inaccuracies, physicians must complete a two-phased registration process on CMS’s website. If a physician does not complete the registration process outlined by CMS, he or she will be unable to review the data before it is published online.

The link for the registration process can be found here, and instructions for the second phase of the registration process can be found here. You must be logged in on CMS’s portal (which requires Phase One registration) in order to complete Phase Two.

Each physician must register him or herself, but at the end of the registration process, he or she can delegate an authorized representative to review and dispute data and edit his or her profile.
